Article 2 - General

2.1 These general terms and conditions apply to all offers from OUTRANCE.

The conditions are accessible to everyone and published on the website https://www.outrancefashion.be/.

2.2 By placing an order, you acknowledge that you agree to the delivery and payment terms. Outrance reserves the right to modify its delivery and/or payment conditions after the expiry of the term.

2.3 Unless otherwise agreed in writing, Outrance does not recognize general or specific terms or conditions from third parties.

2.4 Outrance guarantees that the delivered product conforms to the agreement and meets the specifications stated in the offer.

Article 3 - Delivery

3.1 Delivery takes place as long as stock lasts.

3.2 According to distance selling regulations, Outrance will execute orders within a minimum of 30 days.

If this is not possible (due to out-of-stock or unavailable items) or if there are delays for other reasons, the customer will be informed within one month after placing the order. In such a case, the customer has the right to cancel the order at no cost.

3.3 The place of delivery is the address provided by the customer.

3.4 Outrance fulfills its delivery obligation once the ordered items have been presented to the customer. In the case of home delivery, a refusal of acceptance as stated by the carrier serves as full proof of delivery.

3.5 All delivery times mentioned on the website are indicative. No rights can be derived from these timeframes.

Article 4 - Prices

4.1 Prices will not be increased during an offer period unless legal measures require this or if the manufacturer increases prices in the meantime.

4.2 All prices listed on the website are subject to typographical and printing errors. Outrance accepts no liability for the consequences of such errors.

4.3 All prices on the website are in Euros and include 21% VAT.

Article 5 - Cooling-off period / Right of withdrawal

5.1 In the case of a consumer purchase under the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the customer has the right to return (part of) the delivered goods within 14 working days without stating a reason. This period starts when the ordered items are delivered. If the customer has not returned the goods to Outrance after this period, the purchase is final. Before returning the goods, the customer must notify Outrance in writing within 14 working days. The customer must provide proof of timely return shipment, for example, by a postal receipt. Items must be returned in their original packaging (including accessories and accompanying documentation) and in a new condition. If items have been used, damaged, or altered in any way, the right of withdrawal expires. If the return meets these conditions, Outrance will refund the purchase amount within 14 working days, excluding shipping costs. The return shipment is entirely at the customer’s risk and expense.

5.2 The right of withdrawal does not apply to: - Services that have already started with the customer’s consent before the 7-day period has expired. - Goods or services whose price is subject to market fluctuations beyond the supplier’s control. - Goods made to customer specifications, such as custom-made items or personalized products. - Goods that cannot be returned due to their nature, such as hygiene products, perishable goods, or products that age quickly. - Audio and video recordings or software if the seal has been broken. - Newspapers and magazines. - Betting and lottery services.

5.3 If the customer exercises their right of withdrawal, the return shipping costs are at the customer’s expense.

5.4 If the customer purchases a SALES item, the right of withdrawal does not apply. Sales items cannot be returned.

Article 6 - Data Management

6.1 When placing an order with Outrance, your details will be stored in our customer database. Outrance complies with the Personal Data Protection Act and does not share customer data with third parties. See our Privacy Policy.

6.2 Outrance respects the privacy of website users and ensures confidential handling of personal data.

Article 7 - Warranty

7.1 Outrance guarantees that the products it delivers meet usability, reliability, and lifespan expectations as reasonably intended by the parties in the purchase agreement. Outrance also ensures that the factory warranty applies.

7.2 The warranty period corresponds to the manufacturer’s warranty period. Outrance is not responsible for the product’s suitability for any specific purpose nor for any recommendations regarding use.

7.3 Customers must inspect the delivered items immediately upon receipt. If a delivered item is incorrect, defective, or incomplete, the customer must notify Outrance in writing within 14 days. Items must be returned in their original packaging and in new condition. If the product has been used or altered, the right to claim a defect expires.

7.4 If Outrance acknowledges a valid complaint, it may choose to replace the item or refund the customer. The maximum liability of Outrance is limited to the invoice value of the item. Outrance is not responsible for indirect or consequential damages.

7.5 This warranty does not apply if: A) the customer is in default towards Outrance; B) the customer has repaired or modified the item themselves or through a third party; C) the item has been subjected to abnormal conditions, mistreated, or used contrary to instructions; D) defects result from government regulations regarding materials or product quality.

Article 8 - Offers

8.1 Offers are non-binding unless explicitly stated otherwise.

8.2 If a non-binding offer is accepted by the customer, Outrance reserves the right to revoke or deviate from the offer within 3 business days.

8.3 Verbal agreements are only binding once confirmed in writing.

8.4 Offers do not automatically apply to repeat orders.

8.5 Outrance is not bound by any apparent pricing errors.

Article 9 - Agreement

9.1 An agreement between Outrance and a customer is established after Outrance has assessed and accepted the order.

9.2 Outrance reserves the right to refuse orders or accept them only under the condition of prepayment or cash on delivery.

9.3 Unless otherwise agreed, amounts owed by the customer must be paid within 14 days of delivery.

Article 10 - Images and Specifications

10.1 All images, photos, and product descriptions on the website are approximate and non-binding. No rights can be derived from them.

Article 11 - Force Majeure

11.1 Outrance is not liable if it cannot fulfill its obligations due to force majeure.

11.2 Force majeure includes supplier failures, internet disruptions, government restrictions, and transport problems.

Article 12 - Liability

12.1 Outrance is not liable for damage to vehicles or other objects resulting from improper use of products. Always follow instructions.

Article 13 - Retention of Ownership

13.1 Ownership of delivered goods remains with Outrance until full payment is received.

Article 14 - Give-away

Giveaway vouchers are valid for 2 months. If the winner has not used their voucher within this period, they forfeit their right to it.

Article 15 - Copyright & Intellectual Property

All website content, including design, images, and text, is the property of Outrance Fashion and may only be used for personal, non-commercial purposes.

Article 16 - Ownership Rights

All photos and texts on the webshop are created by Outrance Fashion and cannot be used without permission. Outrance Fashion has exclusive rights over its photos and content.
